First of all, the FBI does not prosecute. They investigate crimes, Department of Justice and charges and tries cases. It’s just hard to understand how a Fox News host does not know that. I suspect they do know it, but they intentionally say FBI because their viewers want to be mad at the FBI more than the DOJ.
