Yes it’s unconstitutional. They are destroying his business and trying to take his property. For no legal fraud. They are stretching the fraud statute way beyond the bounds of fairness. The AG lost most of her case, yet the judge let in statements from deals barred by the statute of limitations. It’s bull crap. Both the AG and the Judge are engaging in misconduct. They are appealing the summary judgment ruling. He made findings of fact that were not in line with real estate valuation in Florida. He used the tax valuation, not the market value. It’s a violation of his rights to due process and right to a jury trial. The statute is a consumer protection statute. This is not equity. It’s punishment. The statute was not meant to be used this way. The state is not the sole arbiter of fraud in business. It’s not legally sound in any way. Both should be brought up on misconduct charges. The judge is an activist. And has stated on video that he cannot keep emotions out of rulings.
