Agreed. He did not do anything but change a few things. The obstruction charge has been held unconstitutional as applied to J6. How can it be applicable to Trump? He did not take those charges out. He also did not really change the other charges. It’s dead. Immunity requires an evidentiary hearing. Intent doesn’t matter. If it’s plausibly related to his actions as president, it can’t be met. His political speech is covered. You have to make a record. Not just briefs and memorandum opinions. He can talk to his cabinet. Just labeling something private is not really how it’s done. Motive doesn’t matter. If he’s talking to his cabinet it’s immune. Appointments clause needs to be addressed too. If the president motivated by what is in the best interest of country doesn’t matter. Motive and state of mind don’t matter. Privilege covers any act that’s within his powers. He was challenging the election. It’s not a crime. The Seal team six example is insane. Stop prosecuting former presidents. It’s not right to say he can’t challenge the election. It’s not election interference to challenge an election. He’s not trying to delay the case unreasonably. It’s going to get delayed. It is a fundamental issue that had to be addressed prior to any trial. Instruct the DOJ to dismiss the cases.
