We have agencies because congress delegated it. Regulations that are not written in accordance with the enabling act are overreach. Like the ATF says the pistol brace is a firearm. No. The court said no. The EPA can’t designate the stream in the property of a homeowner as navigable waters for their authority. A stream not even connected to navigable waters is not navigable. Clean water act does not apply. Wetlands either. Congress can take back its control. But they are lazy. Congress is happy to give the authority to the do all of this. He has the authority to hire and fire people, spend the money, and determine what it does discretionarily. The courts interfering in what Trump is doing is creating a constitutional crisis.
