  2. The idea that the defense goes first is insane. It’s unconstitutional. The defense must know how the DA will charge him. The defense going first is insane. I don’t practice in NY. So I have no compunction about criticizing him. Finding a defendant in contempt for statements made outside of court. It’s outrageous. Allowing Dershowitz to stay is his greatest error. He turned into a raving lunatic. The professor would have objected. 6th amendment says a public trial. He let in Cohen’s federal election law conviction with witnesses and that’s not admissible. The idea that the judge would not let a witness testify that there wasn’t an election law violation. He let the DA argue it. Cohen and his interpretation of election law is not admissible. Not letting the FEC guy testify is reversible error.
