@srenhalsgaard1638 NOT! The prosecutor has "discretion" to not prosecute when the required "elements of a crime" are not supported by the facts. Just doing their job, is the NAZI excuse for doing something that is clearly wrong. The Judge should also have recognized that that the required "elements of a crime" are not supported by the facts. The Judge should have dismissed this case for lack of evidence of a crime.
