  1. You can register trademarks and copyrights in different countries, especially those which a company may wish to do business with in the future. They would have had to have done this, in order to sue in the US. However, it is according to the design, and what is stated on the label, whether there is any infringement. This may not pass muster in a court, if there is enough difference between the two.

  2. You know, someone who owned a Moose, could sue Moosehead, for stealing the name of their pet Moose. It could be done.

  3. rstone7727: Correct. That is how they do it. The suit would cost the defendant more than it does to relabel and rebrand. This has happened several times, with suits from the same company. They even claim that the word, Moose, is theirs. In this suit, their claim to the court, is that this small brewery's product would cause "confusion" in the market.
