He is immune in his "official capacity," not immune to everything. However, calling the Georgia governor, and asking him to look into election fraud, is in his official capacity, as well as calling a peaceful assembly, a political rally, and speaking to the electorate. He also asked a few other states to look into election fraud.

@nethrelm Correct. He was also in his official capacity to remove the files he did, which every president does, when moving from the WH. He didn't personally collect the files, it was the staff, and then they were taken to his home, where they were locked up and guarded by the Secret Service. It's why none of these cases holds water. If he was convicted for the files, that means every other living ex-president could also be prosecuted, and convicted, at the drop of a hat. Many presidential libraries have classified files in them to this day, which are kept locked up until such a time that they can be shown to researchers. .

@Voltroc A candidate runs for reelection in his official capacity to do so. They have a right, in their official capacity, to address the electorate any time they wish, as long as they're still in office. He didn't leave office until Jan. 20th.
