If you are termed "phobic," then that means that you have a clinical phobia, thus, the state is discriminating against people with phobias by these actions. Having a phobia isn't a crime, unless you commit a criminal act in connection to it. Nevertheless, the state is discriminating against people with phobias, and a case against the state could be made over that.
