  1. In the US, I think it runs afoul of the equal protection clause of the 14th Amendment: " nor deny to any person within its jurisdiction the equal protection of the laws." Hate crimes receive harsher penalties, which is unequal justice from the way the penalties for the same crimes were beforehand.
