Of course the President can order the Attorney General to indict a criminal, after an investigation has shown that they have broken the law. If the Attorney General fails to do so, the President can fire the AG, and/or order a special prosecutor. What will happen though, is that Obama will pardon her, the same way that Gerald Ford pardoned Richard Nixon, without him being convicted. However, a pardon is seen as an admission of guilt. According to the book, Guilty as Sin, Obama has already thought about pardoning her.
