The supreme court got corrupted by puritans a ling time ago and they put in an obscenity exemption to free speech in order to ban offensive books at the time and later to attempt to ban pornography and successfully to ban child pornography. The same ruling could be used to ban hate speech as nonprotected illegal speech similar to child porn.
