By this logic, everybody who jay-walks should be fined on the spot. In practice, this is impossible, and more often than not, jay-walking laws are enforced more in order to scoop up money for the police department, rather than to actually make the streets safer.
Not all crimes are equal, and law enforcement has discretion in which ones to pursue. What they choose to prioritise reflects more on the values of the department and the country than it does on the actual letter (or spirit) of the law.
For better or worse, some crimes will go unpunished. The ugly choice people have to make, is whether to pursue otherwise-faultless families who haven't committed any other offences in the US, versus hardened killers and drugs dealers who may go free because nobody would testify against them. If you really think the immigrant is your main concern, than you are a very dark personality indeed.
