Mailmen stand on porches, does this mean we can shoot them? NO. So therefore, if he was not breaking and entering, and simply standing there in a non threatening manner, she should be handed serious charges. If he was actively trying to get into the house or harm the occupants, then I could justify the use of LETHAL FORCE.

@sherrywilletts2450 Totally agree, when seconds matter, police are minutes away. So I can agree on that stance. But I still can’t justify this shooting till more details Come out. From what stands, this is not really justified, sorry. She can’t assume his intent was to do harm to her kids if he made no actions of attempting to do so. She should have waited for police, and if he DID TRY ANYTHING, she would have full legal right to unload. But if he’s just standing there, not doing anything, not attempting to break in. Then she could be potentially facing some serious charges.

@2552Zeus Actually they are not the same. Your property and the land surrounding your home is different from your actual HOUSE. For example read the castle doctrine. She shot through a closed door. You can’t do that, there has to be a justifiable reason. Just because there on your property don’t mean you can unload on them.

This does not apply here, this could be considered murder, what happens if it was an old man requesting medical help? You can’t just blast away and say “I’d rather be judged by 12 than carried by 6” that does not apply here…… now if he was breaking into the house, I’d agree 100% or trying to get the window open to break in. But just standing there on the porch?? Nahh, she should have just called the police
