Because no one understands or uses that term properly for what it actually means. It's a legal term referring to your legal status while you are in court. Not before that. While you are in court while the process is going on you are presumed Innocent. That doesn't apply to the arrest or anytime before then it's just a court term.

@teerollings6919 I think you're the one that's confused. I've made no point about him being detained. Of course he should be detained. I've only pointed out that the phrase innocent until proven guilty is a courtroom term that is applicable in the court. If you were actually considered innocent before that, you would never be detained in the first place.
