  1. I use this argument whenever someone brings up "Was written in a time of muskets." I point out that, using this argument, the 1st Amendment only covers your actual voice (No recordings, amplification, or broadcasts), or physically printed material. The 4th Amendment only mentions private papers. So phone taps and checking on your internet activity wouldn't be covered. I also like to remind them at the time it was written, private people could own the same artillery and warships as the national government. They could, and often did, have personal armies that could easily match anything the government had at the ready.
