  2. Prosecutors need to upcharge in certain cases to ensure some suspects aren't allowed to leave without serious bail. In this case charge attempted murder by arson times however many people were in the buildings she/he/whatever tried to burn. Offer the lesser charge of just arson as a plea deal. I'm pretty sure New York hasn't gone full California level insane and can still request bail for that. Though a woke prosecutor and judge will still probably let a few out.
