  1. It's not the SEC's job to choose winners and losers only to prosecute blatant provable fraud and manipulation of markets by executives, insider trading and such. Notice how Trevor hedges with vague language. When Elon said: "Funding secured" when it wasn't true and it did have substantial effect on price action, that was a case for SEC, had Elon been foolish enough to sell into that he would have been in serious trouble. If Trevor is caught in bald face lies he will be prosecuted but simply hyping with misleading expectations and projections won't do it, I think he's on thin ice but might get away with it.

  3. Another way to look at it: You don't expect Elon to be prosecuted for saying FSD or the semi truck are going to be released/produced by date X and missing that date by yr.s. That's up to us as investors to consider and that's a good thing.
