@allanbadilla8041 Both were moving into the same otherwise unoccupied lane at the same time, it's a VERY common problem in normal freeway driving. Do you drive? Did either use their turn signals? Who was 1st over the line into new lane? (seems to be the Tesla) Who was more aggressive/reckless?--definitely the PU, likewise the PU had better view being slightly behind. Biggest diff between two vehicles actions was speed of movement as both were simply seeking the same empty space. Just from the vid I'd call it mostly PU fault but not 100%, Tesla apparently did nothing last split second to avoid even with a lot of room to work with to the left. Instead it appears to drive right into it. Both drivers oblivious to situation. I'd suggest 70/30 or 80/20, PU/Tesla. "Both take care of your own damages and call it even." lol

Same with the Y driver who was partially at fault.

@cbro_ No it isn't, not in most of America and it has nothing to do with the merging into another MERGING car. Do you even know how to drive?? Passing was not the cause of this.

@davidjames4915 Why don't we talk about what the PU driver did a mile before or the day before? It wasn't a passing accident, it wasn't about acceleration, both of those have nothing to do with the COLLISION, it was about two vehicles CHANGING LANES into the same space. Your biases against PU drivers only undermine your case... this dude was an idiot for getting triggered and aggressive so is MOSTLY to blame.

It wasn't only the Nissan the Y also tried to move into the same lane at the same time, mutual responsibility tho the PU had better view and more aggressive movement.

@cbro_ Do you have a license and drive? It's a legit question, not everyone does. I've driven everything from econoboxs, 1- ton trucks, 4X4's, semi trucks, moving vans, crotch rockets to 200 plus mph sports cars for 40 plus yrs.
