What the defence attorney should have pointed out is that marijuana can make a person more aggressive. If Duante had high levels of marijuana in his system, this would explain why he resisted arrest and tried to flee.

@moderndaydrifter4672 You do realize that Kim Potter had every right to use lethal force on Duante? Her mistake is that she wanted to take out her taser. She should have gone for her gun and unloaded it into Duante as he was a clear and present danger.

@moderndaydrifter4672 No he died due to his own actions and trying to use his car as a weapon. If he had dragged one of the officers they could have been injured or killed. Kim failed only because she thought to tase him instead of shooting him and neutralizing any threat.

@moderndaydrifter4672 Watch the video again both officers were partially in the vehicle. Therefore Kim Potter had the right to use deadly force because the vehicle is now a deadly weapon.

Simon Templar That's not true. Marijuana can make people more aggressive and this may explain the reason Duante resisted arrest and tried to flee. In any case it gives more weight to the defence in that deadly force was lawful in such circumstances.

@nkhirdaji Yes it can. Studies have shown it can increase aggressive behavior in certain people. There are case studies done on this subject.

@Andrew-qb8eh Well in this case deadly force was lawful and necessary because Duante was using the car as a weapon with police still inside. You will note that all officers exited the vehicle only after the shot was fired. Therefore it is safe to say that Kim Potter saved her fellow officers' lives.

Simon Templar Drugs can affect different people differently so there is a reasonable chance that the marijuana in Duante made him more aggressive.
