  1. What the defence attorney should have pointed out is that marijuana can make a person more aggressive. If Duante had high levels of marijuana in his system, this would explain why he resisted arrest and tried to flee.

You will note that all officers exited the vehicle only after the shot was fired. Therefore it is safe to say that Kim Potter saved her fellow officers' lives.
