  1. You've just contradicted yourself. Using a gun should only happen if you're being attacked with a weapon or shot at. A taser is a deadly weapon, when Brooks fired the taser at the officer, he signed his own death warrant. Time for the DA to throw out all these bogus charges against both officers.

No his/her instinct would go into survival mode and he will return fire with deadly force. Brooks played a stupid game and won a stupid price.

Further he didn't just run off. He was a felon who had committed a string of offences ie drunk driving, resisting arrest, assaulting an officer, stealing an officer's weapon and lasted attempted murder. Either he died at Wendy's or in prison. He chose to die in prison.

He resisted arrest, stole the officer's taser and ran away because he didn't want to go to prison. He then pointed the taser in the direction of the officer and was shot. 3. When he fired a deadly weapon at the Officer Rolfe, Officer Rolfe met deadly force with deadly force. Justified shooting. 4. In the midst of a struggle and being shot at which officer is going to try and remember how many times the taser has been fired? Office Rolfe responded with deadly force. Justified shooting.
