In general i think this would be OK if a 100% murder also pays with his life, but as a Jurist with a phd i also knew that any justice systems makes mistakes, and from that perspective, i clearly say that only a 100% working justice system could have the right to judge above live and deat. But no justive system is working with 100% accurency - so with 99% accureny does this mean 1% of unguilty men/woman are murdered by the state. For a reasonable state this could be no option, at ca. 1% fault rate means that the state is murdering his own innocent people. This is a No Go for any civilised country.

  2.  @aubrey5577  Mentally ill and insane are not criminal responsibil and should taken in a special custody as long as they are a danger for the public. The state has to provide a secure and suitable accommodation for them. They are chronical ill and should be treated as such. The illness (ICD-10 code) has of course to be proven by experts - not one. But one has to say, there is often tendency of murder and notorious criminals towards some sorts of mental illness (Psychopathy), but a judge and the experts have to clear if the offender is able to understand his wrongdoing or if the illnes is that advanced that he has no understanding of wrong or evil - legal or illegal.
