  1. I can see how they're not citizens, but non-citizens have been granted at least some constitutional rights, even illegal immigrants. But AFAIK the originalist positition would be silent on this. I can't argue that the court is legally wrong. I imagine it didn't want to get into areas such as miscarriage, fetal nutrition, and a whole host of possible complications.
