IIRC, in Atlanta a taser is considered a lethal weapon. And innocent until proven guilty is for a trial, not for defending yourself; you do not have to prove beyond a reasonable doubt that someone intends you death or grave bodily harm before responding with lethal force. If someone breaks into your home in most of the U.S., that someone is presumed subject to lethal force by the homeowner, unless there is evidence that they were not a threat.

There's a difference between the ideal and the humanly possible. IIRC the officer was not in real danger because the taser had already been discharged and had not been reloaded. But the officer has a split second to identify the gun-shaped object pointed at him, and what I presume are hours of training discriminating what kind of targets to shoot at, with the kind pointing a gun at you being the kind you're supposed to shoot. I think murder in any degree is a ludicrous overcharge for a mistake in a split-second life or death situation. As far as the reinstatement goes, peace officers deserve due process as much as anyone else.
