The driver of the Jeep did not maintain control of his vehicle and entered the intersection when it was not safe to do so. It appears the driver may have been speeding and certainly wasn’t watching the road. If someone parked their car in the same intersection that doesn’t give you a right to drive into the parked car.

Even if the child was already in the intersection, it is clear the driver of the vehicle was not paying attention, and failed to yield to the obstruction.
