Setting aside the ethic debate, there is a legal issue with banning abortion. State does not prosecute unless there is a interest in conviction, conviction should serve the interest of the public. There is no public interest in putting the mother or the doctor in prison. So even if the ban is passed, I don’t see any objective prosecutor would actually pursue charges

@billroadhouse9573 you live under the rule of law, not rule of Christ. Setting aside the fact that this is a controversial issue, which by all legal standard should not be legislated but determined by stare decisis (previous cases), you still have to consider the enforcement and repercussions of this law. It opens up so much legal loophole: if abortion is considered murder, then why is the murderer not prosecuted? If it’s considered illegal drug/medical procedure, then you are overreaching ur authority into FDA territory. So no, law is not a secondary issue. The country shouldn’t be dragged into a legal sh*tstorm just because your “feel like infants are human” Also, legally, infants can only be recognized in court as individual through their parents because all evidence requires a living voice to be presented. Why would a mother present her child if she wanted an abortion? You see? You can believe you are protecting the baby, but you nor the state have no legal power to represent the them. In other word, this is a victimless crime from a legal definition

@billroadhouse9573 no no no how can someone be this legally ignorant? America practice common law, most country than ban abortion practice civil law. You have to bring an actual case to the court before legislating it. And you know why that haven’t happened yet? It’s kinda hard to tell a sobbing r*pe victim to suck it up and have the baby. As for the first part, the same reason applied. If I’m murdered, my family would like to see justice. They would cooperate with the prosecution. How would cooperate in an abortion case? Pro-life activist? On what ground? Under who’s authority? In what court?

Ryan Scaggs yea sure man. Even if that’s true (which probably isn’t cuz people can be anything they want on the internet), you can’t argue that for the past with present situation. Before you left your mother’s womb you not legally considered a human by law, and that’s not just about abortion, that’s that whole civil code. So unless you plan to rewrite the entire civil law of US, it’s a legally stupid thing to ban abortion
