In Canada, if criminal prosecution doesn’t happen in a certain time period, the accused is released. It’s a way to keep prosecutor focus on the real cases

@Marion Cobretti but it was the government that forced the timeline on prosecution in the first place. Deregulation will not solve this issue

@Marion Cobretti I’m not American, but im pretty sure something like this isn’t determined in the constitution. I know you have the right to a speedy trial, but here in Canada the court actually limit the months you have for criminal prosecution depending on the crime. This is what I’m referring to, a case law that gives you an actual deadline

@Marion Cobretti I’m confused, I don’t study US law but I’m sure no state of emergency can supersede constitution. Since US practice common law, the power to prosecute should be shared between executive and judicial branch. Tbh, I did work work with a US prosecutor once, and god let me tell you that guy seem to think he’s Captain America and is ready to take the law in his own hand.

@Marion Cobretti Nah covid mandates don’t need to go though court. I’m pretty sure mandates are within existing executive power. The reason they declared emergency is because, well, it’s an emergency, and probably they want to ramp up the production of PPE

@Marion Cobretti hum, that must be an American thing. I work in forensic so most of my law background is in criminal court. Anyway, the fact they had someone in custody for 3 years without a prosecution really is crazy. There was a landmark decision in Canada where the Supreme Court basically said no trial can take more than 18 month in lower court or 30 month in higher court
