@evelghostrider exactly, don't take any notice of the outdated freedom of the land type people as they know FA about the Law. Not one of them has ever won a single case, they all back down and comply in the end. Educate yourself about the Law, but why fight over whether you need to get out of a car unless you have something to hide.

The dealership is liable for not protecting property of customers, they were presented with reports and advice and chose to ignore them. How did they get insured as most companies will run a mile if there are such reports and warnings. Fobbing people off by telling them to contact their own insurer is not acceptable. The insurer will end up recovering the costs and it will take some time if the franchise can't afford it or wasn't insured.

@douglastodd1947 The dealership or company was aware of the risk and don't appear to have done anything to minimise it or eliminate it - so in Law, they are responsible for loss. When they paid for insurance each year - if they did, the underwriters would require full details, surveys and risk assessments after looking at EA reports. It is not easy to get cover in a known flood area, especially after EA advised there was a risk. I don't know of any insurer that would cover this.

Don't go down the route of "no win no fee finance agreement" type claims if you go after the garage directly. Many will end up losing most of their compensation in commission to claims companies. Up to 40%, so will be worse off. A big company will stretch out any claim until you get bored or can't afford to pay any more and go away. They also scare people by estimating what they will pay if they lose. If you are genuine about helping, you could cover the costs for the group action and let people pay you back once they win. Legal fees are not cheap, expert witnesses are not cheap and neither is obtaining technical reports and surveys etc. This is why most will do as suggested and claim on their own insurance - which is completely wrong, but companies do this all the time. Another interesting fact is that in the UK, NO Government building is insured, it would be too costly and payments in compensation are cheaper than having policies. Insurers will not touch them anyway.

@craigcarter3256 They will if you are a customer of that dealership - this could be the end of the road for them. Who would leave a car knowing it might get flooded and be inconvenienced and lose money?

charity collectors that take a commission are fairly bad! So are charities run as a business.

Areas of the North West were flooding years before this, so not connected. It was down to water companies never investing in repairs or improvements.

They probably took a risk and didn't get cover, hoping that customers would make their own claims. The problem is, customers might NOT be covered for this on their car insurance policies. The wording is very specific about where the car is to be stored when not in use, with minor exceptions, also what is covered - I don't think flooding at a location that is not a home address is one of them, especially a high risk area as shown in reports. The car insurance policy doesn't extend to provide cover for a business you use against loss, theft or damage whilst the vehicle is in their care. They need to be insured on their own policy. Flooding has also been categorised as "Act of God" to assist car insurers with not honouring policies, especially if it has not happened before. If the potential problem was known about or there was a history of flooding, insurance companies would not provide cover for a business unless it was incredibly expensive. I know the trouble after a broken drain in a road! We had to get reports to prove united utilities had repaired it and the cost was higher because one person claimed for damage to a wall/garden. We got a £25 cheque for a week of disruption.

Most of that is FAKE, very easy to spot from the lack of knowledge of the person in Germany of the legal and insurance system. ALWAYS CHECK YOUR SOURCES or you look a fool. There is no point saying a friend told me, or someone working in a company told me - it is a way people spread inaccurate information like urban legends. Cars were tracked using programs like OnSTAR, other manufacturers have systems built in that can easily shut off stolen cars, remotely control and monitor them etc. OnStar was used to record in car audio of criminals and provide their location! It's nothing new.

Some might have thought they would get a big pay-out. The dealership is liable, it is not for the owner to report it to the insurer and make a claim. The terms of the insurance does not cover this, mine states that when not in use it is to be stored in my garage. The dealership insurance, if they got any, is liable now. It must have cost a fair bit for insurance considering the risk and the environment agency report.
