If the previous owner secured a loan against the vehicle when he held the V5, it's down to you for not completing proper checks. You could have used carvertical or even DVLA to see when the last V5 was issued etc. If the car had finance secured on it by the previous owner after your receipt that stated "no finance outstanding" and "not written off", "in roadworthy condition" etc shows you purchased it, then it's not down to you. It is a criminal offence that needs reporting by the finance company as he clearly committed fraud by securing loan against something he didn't own. That will be a lesson to the finance company to check in future.
