It's a never-ending process, as it should be. My favorite parts to it have withstood all kinds of crazy tests and discussions for a long time. This might be the real value of the Constitution. It is politically unlikely that someone would say that people should not have the right to free speech (for example).

I am not sure that I understand your point about ruling from the bench. Can you give me an example?
