  1. Couple of things to Note I believe . One ; Data's Yellow Jumpsuit is his SERVICE UNIFORM . Perfectly appropriate in a Military Setting . And Two ; This was NOT a trial , it was a HEARING by the Judge Advocate to decide IF further proceedings may be Warranted . It's my understanding that a Hearing is less Formal than a Full Trial . Less Protocols . Searching for TRUTH rather than Points of Law . And of course NOT A CIVILIAN PROCEEDING , Military . There ARE some differences in that as well .

  2. You are aware that these people ARE under The Uniform Code of Military Justice ? Not sure what you call that in the U.S.A. , but it pertains to anyone WEARING the Uniform of their Nation . Some different rules DO apply . Data's Yellow , Branch specific , Uniform is EXACTLY what he should wear , BTW . Along with ALL rank and accomplishment badges . Usually it would be Full Dress No1's OR No2's . For EVERYONE in the Room . It is a Courtroom after all . You are correct that the Judge Advocate cannot make a Unilateral decision however . Not at least on a Case like this . But , a Commanding Officer is GOD in/on the facility/asset that they Command . A JAG is an outside specialist with limited jurisdiction . Quite frankly , that Cybernetic Scientist should have been taken to task BEFORE these events .
