For a wounded soldier not to be a legitimate target, three conditions have to be fulfilled 1) he must be wounded; 2) the wound must make him incapable of defending himself; 3) he must abstain from any hostile act and may not attempt to escape. The third condition was not fulfilled, so even the guy on the stretcher was fair game. More. Even the presence of a wounded man that fulfill ALL three conditions, doesn't make suddenly untouchable the able ones around him. If you are wounded, but surrounded by able men, you can't pretend to not be targeted by artillery.
