In the eyes of the law however It was carried out though, surviving an execution is extremely rare that's why it will forever have a legal grey area Especially if you consider the cruel and unusual aspects of repeated execution attempts

@freewithnature no idiot they don't get off scot-free typically what happens in the case of a survival in the execution attempt their sentence is commuted down to life imprisonment But as I said because it's an extremely rare case done typically on a case-by-case basis but most often execution is commuted down to life w/o parole

@nerofl89 not false at all it was carried out we'll see what happens as a result of a survival of an execution attempt because they are extremely rare there is no real established protocol Most often when it does happen though it is commuted down to life imprisonment but we will see if the cruel and unusual punishment argument is enough to commute it down or if the state government will try again The survival of an execution and what to do afterwards with the inmate is done on a case by case basis

@RBCire it was carried out the records of the court system and everything else is done to prove it But we will see what happens in these extremely rare events of which there is no established protocol My guess is most likely the defense will argue cruel and unusual punishment against a second execution attempt and try for a commuted sentence of life imprisonment I don't know if it will be enough but who knows They don't get off scot-free merely because they survived they never have

@gavincrouch it's not false it will always be a gray area and again I keep saying that the cruel and unusual punishment defense will always be implemented whenever a survivor of an execution is found

I thought the meme was if you survive execution you're pretty much good to go legal wise as your trial and sentencing was carried out And the state can't try you again for the same crime unless new evidence comes to light Against that's just the meme not sure if it's a real defense and nor would I want to go to the defense of a guy who committed 1st degree M

@Firedrake1313 you can't do repeated execution attempts without someone invoking the cruel and unusual punishment however So no, the sentence was indeed carried out but I don't know if it will be enough of a Defense and commute it down to life imprisonment w/o parole
