  1. ​@BxndoBunny You can be in custodial detention for an amount of time that is limited by whatever the hell your state issues it for. New Orleans is infamously 24 hours. New York is 72 hours. Most places are 24-72 hours. During the detention you still have all of your rights and should be Mirandized

An example of a limited custodial detention is the hard 15 minutes that the Supreme Court imposed on the entire nation for traffic stops, because a detention has to be reasonable for the scope of the investigation and police were extending stops SOOOO MUCH in SUCH AN ARBITRARY fashion that seemed to reflect racial profiling. If a stop is longer than 15 minutes without definite evidence of a secondary crime, the stop is thrown out entirely. Custodial detentions also happen to people at crime scenes ie for fights, mass casualty events, injured persons, etc. For example: an active shooter scene will have the police cuff anyone that matches the description of the shooter, then have them escorted to safety. Or a police officer may pull up to a fight and put both persons in handcuffs so that there is time to get the details. Custodial detentions HAVE TO BE reasonable for the purpose of the investigation. In this case she couldn't leave until after the evidence was processed and the warrant was served.
