@nickgarnero9843 Just had a hard time believing that in 2024 someone was still saying that it was all peaceful. A B S O L U T E L Y was not.

Murder is murder. Not even cops are really authorized to take another citizens life unless they are specifically threatened. Penny might get a minor sentence but legally he is guilty of taking another persons life.

@kitalalaris IM A NEW YORKER. I remember as it became a news story. Guy was talking junk and as a New Yorker you get used to folks like these. No issue. Penny overreacted and thought - likely pushed by Fox warning shots - that the guy was going to do something. Additionally, if he was defending himself, he would STILL be liable for murder. You gotta understand that there are very few instances where lethal force is justified by a citizen. Talking junk on a subway train isnt one of them.

@allblooz You made that up. Im a New Yorker and 50% of prisoners in NY are black. (Gotta thank you however, im starting to see how folks have been misinformed about the facts behind this and other similar cases). The prison population is about 50 thousand.

He killed a person. Color doesn't play a part. What if color was a factor in deciding if a person was guilty of murder. Oh, yeah. there was the lynching of many innocent black's back in jim crow years. Just a factoid. He still needs to be prosecuted as a citizen that killed another citizen.

@jermiahduddleston4695 IM a NEW YORKER. Penny overreacted as some may do. Im very reasonable, but so are the charges against him. He is up for manslaughter not murder. So reasonable as the justice system can be, they felt that he went too far in thinking he had to choke someone. He did it past the time where the guy passed out. Thats when his thought that his - marine trained life - should have been: was no longer threatened. The system is reasonable too.

@ShinFahima No! Misinformation. There was no knife. Im a New Yorker that remember as it was becoming a news story. Additionally lets suppose there was one. Once the trained marine had subdued him, its over until the cops arrive to arrest the guy. That's why its manslaughter . Once the guy was immobile and passed out, the threat was removed. All past that time was unneeded.

@rikubrown8109 Thats what Im saying too. But in this case he went beyond just protection. He held him in a choke hold for over 6 minutes after his body went limp. manslaughter never the less but, shows how "protecting" oneself is a responsibility also.

@spencerbowden2979 Once again <ive commented before>. You are being mis informed. Im a New Yorker. I remember it as it happened. There was NO weapon. He was yelling, making noise at the passengers on the train that he needed help because he was hungry. I have seen these types before. Some sing, some dance, some have a hat out, some play music, a few tell jokes some just ask for a favor various types of folks - "brother can you spare a dime". There was no weapon. To cut to the chase, no matter what brought on his defense since a person died he will be held accountable. Its the law. Lesser charges will likely apply. But its manslaughter. Straight up.

@fearlessfosdyke13 Tricky question and I realize that its real. Im a ole school New Yorker. I am admittedly jaded by seeing similar and others over the decades. Dozens of different events. Never has one actually carried out the threats - if there was one - usually its just a bit too forceful ask for something. Someone gives the guy a dollar and they get off the train and disappear. I might have given the guy a dollar since he loudly said he was" hungry and needed help". I would have waited till he was someway away from me and had the dollar out for him to take. This was the first time that i have heard of in which some defense was needed. It usually trespassing or something. Never really violent. Those guys dont ask. I think Penny overreacted, but Im not military and have seen it before. Before you think that penny was in the wrong overreacted isn't in the wrong. Its just a better way to do things. Tough case because panhandlers do get crazy at times. I just saw hundreds ask and go away when they dont get something. Nah. I would have waited to see it this was just another one that got loud and went away when he didn't get something.
