There is a lot of that that comes out in Law and Crime chat. Often with no evidence wild theories come up that the chat talks itself into believing must be true. The Zachariah Anderson case had no DNA evidence (well one possible blood spot in his truck that had male DNA that couldn’t be ruled out it was the victim - or Zachariah Anderson) and the jury convicted. I assume the jury didn’t understand “could have been his DNA or the victims” didn’t mean “was the victims”.

This can happen with any jury for any reason. Sometimes the jury just gets it in their head it’s a different case (jurors ask for transcripts of witnesses who never testified for instance) or come down on some third suspect neither defense or prosecution ever mentioned (the mystery man with no face).

Something similar happened in the YNW Melly case. They had him basically dead to rights but refused to convict.

This used to be the case for lynchings. Many times people would refuse to indict or refuse to convict because they believed they were doing the right thing. SMH.

If it’s a civil suit it would be against the boys charged with murder. It’s likely it would succeed since civil it’s a preponderance of the evidence (greater than 50%) rather than beyond reasonable doubt (95%+). However you’re suing the kids family’s and they likely don’t have any money to begin (certainly not millions) with so it would be futile. You typically only see that with rich kids.

Amazing analysis. Branca would be proud. Would be wonderful to see AJW and LOSD have a discussion about this. Think it would help both their audiences since they cover many similar topics. The proportionality is also a little sticky. Since Ethan was apparently not the one shooting the gun was it a proportional response to punch him in the head for getting hit by a water gun by someone else?

They probably didn’t expect to get killed for having a suped up water gun.

There is no double jeopardy period in the US. If there is a not guilty verdict, it cannot be challenged by the prosecution.

The guy in the video is also what - 5 feet from his target? He even says that it wouldn’t rip if it hadn’t had the space behind it. I used to shoot pellet gun with air cartridges and you can get some force behind them but you had to use wad cutters to get it to tear the target and sometimes when your canister was low it wouldn’t even go 10m.
