You’ll spend more in court defending your liberty than that property was worth. Say they take a computer and a TV and hell, let’s throw in your brand new car. Know how fast you’ll rack that up in legal bills even if you were justified? Even if the police think you were justified?

This seems more like the Curtis Reeves case. Guy in a movie theater, fight starts over a phone being used, the victim tosses something and hits the Reeves in face, reeves glasses get knocked off, reeves shoots him in response. Only reason Reeves received a not guilty was because there was a 30+ year age gap between the two and in Florida that is a felony assault (since reeves was >70).

Because ultimately they are responsible for every charging decision. The ADA can bring it to them, the DA is the one who signs it.

@yourdadsotherfamily3530 and there are thousands of other cases where the opposite is true. It varies on the jurisdiction significantly. It also varies on the man power they have to prosecute and if they have already lawyered up since it’s a lot easier to get a confession out of someone (guilty or innocent) if they don’t have a lawyer
