Yes, it was, because Virginia became the 38th state to ratify it in 2020. BUT, trump immediately called Bill Barr and told him to call the Chief Archivist (at the time - we have a new one now) and tell him to NOT put the ERA into the Constitution. (Because trump had promised the evangelicals that he would get rid of Roe v. Wade, which he did, and Roe could NOT have been overturned if the ERA was in the Constitution)). I would like someone to explain to me how the President has that right to do that, but that’s what happened (and that was BEFORE SCOTUS said whatever the President does is OK). And, if Trump, apparently, had that right, why can Joe Biden not now call Merrick Garland and tell him to call the Chief Archivist and tell her to go ahead and put the ERA into the Constitution, especially now that SCOTUS has said that anything the President does regarding his “official duties” is OK to do. So my opinion is that Biden has that same right…now.
