  4. That would take: 1. The judge to agree to resign for absolutely no reason 2. Biden agreeing to put a stain on his name by nominating an unqualified, unwanted, radical, fully political person 3. The senate giving consent, making each person who gave consent very unlikely to keep their job in 2 years, as that is simply such an abuse of power (putting a politician instead of a judge) 4. Having the democratic party agree to this move, which will backfire in the next election, as it looks like meddling with the will of the people who just rejected this person
