Don't expand the Federal Supreme Court, ABOLISH IT and the states can have their own Supreme Courts, as they already have. If there must be a Federal Supreme Court, model it on Australia's High Court with limited tenure, mandatory retirement age and the candidates for the bench chosen by a two-thirds majority of Congress and Senate in joint sitting session.

@Trace-l7k As I understand it, though, the state Supreme Courts don't have the same "free-for-all" lack of constraint as does the Federal Supreme Court which has proved itself to be completely rogue!

@davedthomson The Supreme Court is ROGUE and MUST BE BROUGHT BACK IN LINE! The Supreme Court's role is to interpret the Constitution, and determine what laws at both the State and Federal Level are Constitutionally valid or invalid. But this DOES NOT GIVE THE SUPREME COURT ANY RIGHT TO OVERTURN ANY LAWS WHATSOEVER! The Supreme Court can only MAKE ADJUDICATIONS BASED ON LAWS AS THEY STAND! As it stands now, the Supreme Court has FAR TOO MUCH POWER AND IS ABUSING THE POWERS IT DOES HAVE, PLUS ASSUMING POWERS IT HAS NO RIGHT TO ASSUME! Laws are enacted or removed by the LEGISLATURE, being Congress and Senate. If a law is deemed by the Supreme Court to be invalid, then the Supreme Court should ADVISE THE LEGISLATURE TO ACT! The Supreme Court has ABSOLUTELY NO RIGHT WHATSOEVER to overturn ANY law(s).

@davedthomson A court can ONLY adjudicate BASED ON THE LAWS AS THEY STAND. A court, any court, up to and including a Supreme Court, has ABSOLUTELY NO RIGHT to create or overturn any law whatsoever! Laws are determined(enacted or rescinded) by the GOVERNMENT! END OF STORY!

@davedthomson I'm in Australia and we also have three divisions, Our Parliament's lower house, The House Of Representatives enacts or repeals laws as required, the upper house, The Senate scrutinises the laws before they can be passed, noting amendments that need to be made, then sending the law(still as a bill, technically speaking) back to the House Of Reps for those amendments to be made. In the event that a bill passes the lower house unamended, but the upper house rejects the bill as unamended, or with amendments the upper house rejects, and vice-versa. If this happens three times consecutively, the Prime Minister then has the trigger to call a General Election, dissolving both houses. The High Court in Australia DOES NOT HAVE THE AUTHORITY, OR EVEN RIGHT to overturn any laws once enacted by Parliament. The High Court's sole purpose is to make adjudications BASED ON THE LAWS AS THEY STAND! The Australian system does have its flaws, but even with these flaws, our system is FAR AND AWAY SUPERIOR to that messed-up pile of manure that is the American system.

A President should have ABSOLUTELY NO SAY WHATSOEVER on who sits as a Supreme Court Justice. A President should be Neutral and have ONLY A CEREMONIAL ROLE! The procedure of appointing or, if necessary removing Supreme Court Justices must be vested with a joint sitting of Congress and Senate casting a two-thirds majority vote.

The Supreme Court is VIOLATING ITS CHARTER if it sets or throws out laws. The Supreme Court HAS NO RIGHT WHATSOEVER to set law or throw out any law. The role of the Supreme Court, or any lower court is to MAKE ADJUDICATIONS BASED ON LAWS ENACTED BY GOVERNMENTS!
