The USA has a too-wide interpretation of the concept of qualified immunity. Some examples that I know go wrong: * A senator on the campaign trail or talking to journalists and smears other people should NOT have immunity from slander charges. * A cop who uses deadly force when his (or anyone else's) life is not directly threatened should NOT have immunity from manslaughter charges. * A government spokesperson who lies to the public should NOT have immunity but be liable for the consequences.

This case is absurdly simple. The US Constitution was created with the explicit purpose of preventing a despot taking power. The one thing that discriminates a despot from a democratic leader is that a democratic leader is subject to the (Criminal) Law at all time. And that he doesn't get to determine the Law himself. But if the despot is not subject to the Law, it is irrelevant who determines the Law. The despot has become a law unto himself. Trump should be indicted for making a frivolous appeal, and this argument should no longer be allowed to delay his other cases.
