  2. There is ample jurisprudence that "he made me do it" is not a viable defense. Even if Trump had authority to directly order these acts. But he doesn't, so these people had freedom to make their own choices, and will be held responsible for them.

  3. And in the Nuremberg trials, subordinates had a choice between obedience and death. But they still got condemned. In this case, there would have been no consequences had an individual not complied. If there would have been, we should have heard about it in their defense pleas.
