  1. The test of whether a fetus is viable outside the mother is a very sensible one. Because it also covers late-term miscarriages. It is absurd to somehow "protect" the life of a deceased fetus, and thereby endanger the life of the woman. Also, whether the fetus is viable is a medical decision, and this gives doctors (in consult with their patients and some peer-review / second opinion process) the authority to make such decisions. Thus it also covers possible future improvements in the care for early-born children. I applaud this judge for such a well-balanced decision. And for taking on the fascists, and highlighting exactly where they are wrong.
