  2. "Absolute Presidential Immunity" does not exist in a country that has the Rule of Law. Even if this is not explicit in the Constitution, this is so fundamental that no-one with any legal knowledge would consider it even for a second. The Rule of Law, a concept that was written down in the Magna Carta in 1215, means that the Leader / King / President is himself subject to the Law. It is a conditio sine qua non for democracy. If SCOTUS allows this defense, the USA is done as a democracy. If it happens, Biden should immediately remove the Trump appointments from SCOTUS and prosecute them for insurrection and failing to protect and uphold the Constitution, using the authority SCOTUS just gave him.
