This is such an asinine argument. I this were true, the President would have more power than most kings since the Magna Carta. Whereas the specific goal of the USA was to not have a king who is above the law. It would mean the immediate end of democracy. It would give him the power to do anything. But in the very unlikely case SCOTUS goes with this in the eventual appeal, Biden should immediately use his new power against Trump and the MAGA movement. Including throwing the MAGA goons in Congress, the Senate and SCOTUS into prison. I don't think he would be impeached for that.
