Insurers / health organisations are there to pay for the costs, not to determine liability or guilt. Also has to do with client privacy. No one has the right to question someone on how that person sustained an injury. That is not information those organisations need to know to pay for the costs.

  4. This whole episode just shows that going against feedback from the work floor is a baaad idea. Probably the producers should be held responsible, but I fear for that young armorer who was, it seems, out of her depth. On reason why it is a bad idea to hire junior people for a role like armorer is that you need people who are confident enough to push back against management when things become unsafe.

Justice can only be established through a court run by authorized and trained professionals of high integrity & impartiality, in accordance with the Law of the land, where there is a fair examination of the evidence & witnesses by both the prosecution and the defense under the presumption of innocence, and where the proper punishments are applied in accordance with the crime, not the person who did it. I.e. by Lady Justice wearing her blindfold, using her scales and wielding her sword. Sadly, in the USA, it seems Lady Justice's blindfold has gone missing.

  8.  @cakestalker  Glenn Kirschner has argued that one could invalidate pardons if there was a conspiracy between the one being pardoned and the one issuing the pardon. That might have been a route of attack. Also, one could try to find additional crimes by Nixon not covered by the pardon. Also, it could be argued that a pardon needs to be for a specific crime (as it also implies guilt), and thus blanket pardons are null and void. These are uncharted territories of the Constitution. Personally, I think such battles will be necessary quite soon, given that Trump has issued many pardons to people he conspired with, and has probably issued a blanket self-pardon.

In developed nations, you don't need to beg in order to get insulin or a bypass, or litigate a boy because you broke your wrist. But rest assured, we also laugh at the UK for its Brexit disaster.

  23. Arguably, the ban on loaning money is what will hurt Trump the most. Loaning more money has always been Trump's goto safety blanket. Chances are, he can't even appeal this verdict because he doesn't have the cash to place the disgorgement in escrow. And probably, he is too stupid to realize or acknowledge the danger he is in. He should be selling his properties ASAP, just so he can appeal the verdict. But instead he is trying to run out the clock. That will not help him in this case.

What you really complain about is that it is difficult to become as big as Twitter, because they have a large existing customer base. But that is just how business works. You can start your own car manufacturing company no problem. But it will take a LOT of effort to grow that company to the size of Toyota, Ford or Volkswagen. Same with a building your own Twitter competitor.

  33. The argument that "no-one lost money" is absurd. Banks require correct valuations to manage their risk portfolio. That has nothing at all to do with whether a particular loan was bad or good. Trump caused the Bank to run much more risk than they knew, which normally would mean (much) higher interest rates than for low-risk loans.

But it does refer to Common Law for precedent how the Constitution should be interpreted. And what do you mean by "politically motivated"? Do you think the dissenters will get more votes because of this? That is absurd. The Dissenters have been appointed for life, they don't give a damn about the politics of an issue. I find the arguments by the dissenters to be much more compelling that the arguments by the majority. Overthrowing 50 years of legal precedent without any change in the Constitution or underlying societal issues, that is legal "dreck".

  46. Being defamed by a public figure automatically puts the victim in a spotlight. That should not be cause for the "actual malice" condition to be invoked. That one is for when the victim is a public figure, not the perpetrator. In fact, one should argue that because of the weight carried by a public figure, they should be more careful of their words and claims than regular persons, because the consequences of defamation by a public figure are much larger than usual. So claiming that the "actual malice" condition should be used in this case is absolute legal nonsense. The companies involved were NOT public figures before being brought into the limelight against their will by the perpetrator.

Alternatively, you have to wonder at the insanity which placed a bloody container terminal right next to downtown Baltimore, 160 miles from the coast? In such a confined space? Where I live, our largest container terminal was built on an artificial island right on the coast. No need for these behemoths to come near our bridges. Build some prime highway, railway and inland waterway to it and hey presto, a terminal that can service a continent. I am, of course, talking about the Maasvlakte terminal, part of Rotterdam harbor.

  49. If hate speech can not be banned outright, it should be easy to convict people who utter hate speech when it likely caused people to be hurt or properties to be damaged. Speech can have consequences. In case you haven't noticed, the USA is getting in a zone where people are prepared to do violence because they feel their rights are threatened, as a result of hate speech. This can get very ugly. You may frown at these stupid Europeans for having anti-hate speech laws, but they have learned through painful experience what it can lead to. That the USA has yet to learn that lesson is not due to nobody being hurt there through hate speech, but by the victims mainly being minorities, like the native Americans, immigrants, people of color, LGBTQ+ people etc. The thing about hate speech, and the fallacy of "hate speech should lead to more speech", is that if the hate is spread by a large-enough group, it will drown out the victims and the silent majority. As happened in 1930-ies Germany, and is happening in the USA right now. A minority group can not defend itself against an onslaught of hate. It needs the protection of the Law. Especially when ruthless politicians and media moguls are spouting the hate.

The Rule of Law has a divine element, with Christianity, Judaism and Islam all believing God is the ultimate Lawgiver -- and who placed Himself under said Law, those being the ultimate example of Rule of Law. History has shown a slow convergence of all of humanity towards Rule of Law, except for some temporary backlashes.

  54. While it is unique for the USA to have a former president convicted, it is definitely not unique in the world. France, for instance, convicted a former president a few years ago. In Democracies, no-one is above the Law. Yet it has looked like there were two separate sets of law in the USA, one for the poor, one for the rich. Trump's case will be a huge shake-up of the legal profession in the USA.

  55. The main problem with the USA is how it appoints its judges. Because judges are appointed by politicians, they become political appointments and vulnerable to partizanship. In my country, judges are selected by other judges. They are appointed by the King, who is a-political. For high-court judges, the government picks someone from a shortlist drawn up by the existing high-court judges. And it is really easy to get a partizan or in any other way biased judge from a case. Also, the authority of SCOTUS should be curbed. It should not be possible for SCOTUS to change the Law after it has been signed by the President. Their role in judging whether a law is Constitutional should be performed before that signing. That is how it is done in my country: we have an advisory body comprised mainly of (former) judges and scholars, with a staff of almost 700 people, that check every new law. Their advice is followed in the vast majority of cases. The current US system makes it unclear what exactly the Law of the Land is, SCOTUS can change it on a whim. That is extremely bad governance.

Those bridge pylons should have been reinforced as part of building the container terminal. Same for the pylons of the bridge 20 miles downstream, which is yet to experience its Murphy Moment. How should they have been reinforced? Artificial / concrete islands 50 meters upstream and downstream of them, for stopping any ship on a allision course.

Either build a bridge with a single span so it has no pillars that can be knocked out from under it, or build the road on a dike with a single span bridge in the middle for ships to pass through, or build a tunnel, or a combination of a dike and a tunnel. The best way to survive an allision is to prevent them by design. OR, even better, don't build a bloody container terminal expecting to service sea-going vessels 150 (!) miles inland! We have built ours, the biggest in Europe, on an artificial island right on the coast. Big ships have to navigate zero bridges to get there. It sees MANY times the traffic this Baltimore midget-terminal gets, loaded with goods for a whole continent.

  62. The SCOTUS decision, including the minority opinion, is deeply disturbing. It holds the rights of a candidate to be eligible to be more important than the rights of the People to not have a President who is an insurrectionist. Being a candidate for the highest office in the USA is a privilege, not a right. There should be more protections against bad candidates, not less. IMHO, the Biblical standard for high office should apply as well for the Presidency: "to be above reproach, faithful to his wife, temperate, self-controlled, respectable, hospitable, able to teach, not given to drunkenness, not violent but gentle, not quarrelsome, not a lover of money. He must manage his own family well and see that his children obey him, and he must do so in a manner worthy of full a respect." Trump fails on all of these conditions, except perhaps "hospitable" by virtue of owning hotels and resorts. But if the way the Secret Service people were treated by some of his children is an indication (they weren't allowed to pee at the property they were protecting), they are only hospitable in exchange for a lot of money.
