  1. Being defamed by a public figure automatically puts the victim in a spotlight. That should not be cause for the "actual malice" condition to be invoked. That one is for when the victim is a public figure, not the perpetrator. In fact, one should argue that because of the weight carried by a public figure, they should be more careful of their words and claims than regular persons, because the consequences of defamation by a public figure are much larger than usual. So claiming that the "actual malice" condition should be used in this case is absolute legal nonsense. The companies involved were NOT public figures before being brought into the limelight against their will by the perpetrator.
