You are deliberately not comparing like with like. When documents were found in Biden's former places of work he told his former staff to immediately return them to the National Archives. There was no intention to deliberately hold onto them. In Trump's case the situation was entirely different. Trump initially denied that he had any documents at all. Then he admitted that he did have them but, when asked to return them to the National Archives, he refused to do so, claiming they were "his". Even top secret defence papers. That was a breach of the Espionage Act. That is why the Attorney General asked the FBI to recover them.
