No, Biden wasn't taking documents whilst he was a senator, but as Vice-President he was entitled to see classified documents. Secondly, after he left the post of Vice-President, and it was discovered that the documents were still (unwittingly) in the VP's possession he immediately returned them to the Natonal Archives. On the other hand, Trump firstly denied having government documents at all. Then he admitted that he had them at Mar A Lago, but refused to return them to the National Archives.
