If you're using tax treaties to claim benefits in your home country while living in Dubai, whatever the treaty says will take precedent. If the treaty refers you to local laws, then the law that the UAE passed will apply but if the treaty defines the residence period for the UAE, then the treaty will apply (for example, in the treaty with India, it clearly says that you have to live in the UAE for 183 days to be considered a resident).

@davelawson2564 Read my sentence again. I am talking specifically about claiming UAE tax residency if you are trying to claim treaty benefits with India. You haven't understood.
